IN CONSIDERATION for being permitted to participate in the Burnt-Hills-Ballston Lake Summer Recreation Program (BHBL Youth Activity Fund, LLC).

THE UNDERSIGNED PARTICIPANTS:

In consideration of being permitted to participate in the Burnt Hills-Ballston Lake Summer Recreation Program (hereinafter, “the Program”), I, the undersigned Participant, or as Parent/Guardian of the minor Participant named above, hereby agree to the following Waiver of Liability and Indemnity Agreement:

1. Acknowledgment of Risks: I understand and acknowledge that participation in the Program, including but not limited to various recreational activities, sports, trips, and social events, carries inherent risks of physical injury, illness, death, and property damage. These risks may arise from, but are not limited to, the nature of the activities themselves, the acts or omissions of other participants or third parties, the condition of the premises or equipment, and the negligence of the Burnt Hills-Ballston Lake Summer Recreation Program, its employees, volunteers, agents, or representatives (collectively, “the Program Entities”). I am aware of these risks and voluntarily assume them.

2. Medical Condition and Consent: I affirm that the Participant is in good health and physical condition and does not have any medical conditions, disabilities, or special needs that would prevent or limit safe participation in the Program, unless otherwise disclosed in writing to the Program. In the event of an injury or medical emergency, I authorize the Program Entities to obtain medical care, including transportation to a medical facility, as they deem necessary. I agree to be responsible for all costs associated with such medical care.

3. Waiver and Release of Liability: I, for myself, my heirs, executors, administrators, and assigns, hereby waive, release, and forever discharge the Burnt Hills-Ballston Lake Summer Recreation Program, Burnt Hills-Ballston Lake Central School District, and their respective officers, directors, employees, volunteers, agents, and representatives from any and all claims, demands, actions, or causes of action of any kind, including without limitation, those arising from negligence, for any personal injury, illness, death, or property damage sustained by the Participant while participating in the Program, or while on premises used by the Program, or while in transit to or from Program activities.

4. Indemnification: I agree to indemnify and hold harmless the Burnt Hills-Ballston Lake Summer Recreation Program, Burnt Hills-Ballston Lake Central School District, and their respective officers, directors, employees, volunteers, agents, and representatives from and against any and all liabilities, claims, demands, costs, expenses (including attorney’s fees), and damages arising out of or in connection with the Participant’s participation in the Program, including but not limited to, any claims for personal injury, illness, death, or property damage, whether caused by the negligence of the Program Entities or otherwise.

5. Program Rules and Conduct: I agree that the Participant will abide by all rules, regulations, and instructions of the Program (as outlined in the Parent Handbook) and its staff. I understand that failure to do so may result in the Participant’s dismissal from the Program without refund.

6. Severability: I agree that if any portion of this Agreement is held to be invalid or unenforceable, the remaining portions shall remain in full force and effect.

7. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of New York.
